REGULATIONS ON MANAGEMENT OF E-COMMERCE TRADING PLATFORM 102bid.COM

I. GENERAL PRINCIPLES

The 102bid.com e-commerce trading floor, operated by 102bid Joint Stock Company, provides online ordering, home delivery and voucher/discount code usage services. These regulations apply to members (merchants, organizations, individuals) who legally participate in transactions on the floor, are recognized by 102bid.com and use the services provided by the floor.

 

1.   Definition:

        Seller: is an organization or individual using an e-commerce website to provide goods or services to consumers. (According to the provisions of Clause 4, Article 3 of the Law on E-commerce).

        Buyer: is an organization or individual using an e-commerce website to purchase goods or use services provided by sellers on the e-commerce platform. (According to the provisions of Clause 5, Article 3 of the Law on E-commerce)

        Members: Includes both registered Buyers and Sellers.

 

2.   Operating principle:

Transactions on 102bid.com must be transparent, public, ensure consumer rights and comply with Vietnamese law.

The traded products/services must comply with legal regulations, not be on the list of prohibited business or advertising, and be consistent with the policies and community standards of 102bid.com.

Members freely negotiate on the basis of respecting the legitimate rights of the parties, without violating the law or the exchange's policies.

 

3.   Scope of application:

This regulation applies to all members who register an account, buy/sell products, provide services or use promotional services on 102bid.com.

Members must learn and comply with the rules, policies, guidelines, and community standards published on the website 102bid.com.

II. GENERAL PROVISIONS

1.   Information about the E-commerce Platform

·  Domain name: 102bid.com, 102bid.vn, 102bid.com.vn.      

·  Operated by: Viet Market 102 Joint Stock Company.      

·  Address: Ground Floor, Base Block, Dragon Hill Building, Subdivision 15A1, Nguyen Huu Tho Street, Phuoc Kien Commune, Nha Be District, Ho Chi Minh City, Vietnam.      

·  Contact:  https://102bid.com/contact-us.        

2.   Definition

·  Seller: Merchants, organizations, and individuals who register an account to create a booth, post information to introduce, sell, or promote products/services. Sellers must provide information according to the law.      

·  Buyer: Merchants, organizations, individuals who register an account to learn about and purchase products/services on the 102bid.com platform.      

·  Members: Including Sellers and Buyers, recognized by 102bid.com and using   102bid.com  services .      

·  Voucher/Discount Code: Only used in transactions identified by 102bid.com, in compliance with the floor's regulations.      

3.   Compliance with the law

This regulation complies with current Vietnamese law. Members are responsible for understanding and fulfilling their legal obligations when participating in the floor.

III. LIST OF PROHIBITED TRADING AND/OR CONDITIONAL TRADING PROHIBITED PRODUCTS AND PROHIBITED ACTIONS AT 102bid.COM

A.     List of prohibited products

1. Illegal services

a. Money in circulation, money issued by the old regime, counterfeit money (except hell money), virtual money (Bitcoin, Pi,...), activated credit cards and debit cards.

b. Stocks, shares, securities and seals.

c. Gambling machines and products that support gambling.

d. Product information and value are not clearly displayed / products of a chance/ gambling/ lottery nature / products in the form of secret gift boxes, random products.

e. Providing services such as: electronic money deposit, recruitment, real estate brokerage, insurance, etc., especially illegal services such as prostitution, is prohibited on the   102bid  .com platform.

2. Military, law enforcement and government equipment and uniforms

a. Items and equipment provided by the government, police or military.

b. Equipment, costumes, and items containing images of the national emblem.

3. Reactionary documents & Information that violates national security

a. Products related to terrorism or terrorist organizations.

b. Products related to campaigns, elections, political issues or public debate, war, etc.

c. Products that support, oppose, or attack a politician or political party.

d. Books, newspapers, publications, and discs containing political elements.

e. All products/devices that have map images or use maps.

4. Copyright infringement 

Counterfeit, counterfeit, or unauthorized copy of a product or item that may infringe the copyright, trademark, or other intellectual property rights of third parties.

5. Guns, weapons and products shaped like weapons 

a. Guns, weapons and products shaped like weapons:

- Toys shaped like guns, grenades, bombs, mines..., except toys that spray water or create bubbles;

- Steam or spring-loaded gun that fires plastic bullets or other types of ammunition.

- Steam guns; guns that shoot light or explosives.

b. Swords, spears, bayonets, daggers, crossbows (made of various materials including wood, bamboo, compressed paper...). Toys shaped like other weapons.

c. Tear gas, pepper spray, CS spray, suffocating gas spray, toxic spray, anesthetic spray, itching spray.

d. Batons, electric batons, metal batons, rubber batons.

e. Bear punch, self defense ring.

f. All parts, kits, ammunition, components and accessories for firearms, including but not limited to:

- Internal gun accessories such as: bullets, magazines, barrels, weapon conversion kits and firing pins.

- External gun accessories such as: silencers, gun stocks, breech blocks, fire control components and triggers.

- Any other product which, at  102bid 's sole discretion  , may be used to make a firearm or firearm part.

g. Knives and other bladed products, including but not limited to:

- Switchblade/Butterfly knife.

- Any knife or other object with a blade.

- Any object that is pointed, or disguised or capable of being transformed into a knife or weapon to cause injury. Does not include kitchen knives (cooking knives).

6. Prohibited substances, stimulants, addictive substances, drugs and illegal drug paraphernalia

a. Drugs (including synthetic drugs)

- Drugs, steroids and other drugs prohibited by law.

- Laughing gas, ecstasy, anesthetics, narcotics, stimulants, marijuana, hashish…

b. Any chemical, ingredient or raw material used to produce narcotics or stimulants, addictive substances.

c. Drug paraphernalia such as products used for the production, manufacture or consumption of drugs. For example, glass pipes or vaporizers designed for smoking or using drugs, etc.

d. Images or content containing cannabis: cannabis leaves, 402,...

7. Tobacco

a. Cigarettes, tobacco, electronic cigarettes, cigars, smokeless tobacco, Shisha,...

b. Tobacco ingredients contain nicotine, essential oils,...

c. Smoking equipment, including pipes and rolling papers, cigar cutters, electronic cigarette accessories, etc.

8. Products for adults

a. Sex toys: Vibrators, Dildos, Cock rings, Sex dolls,...

b. Products used for Sadomasochism and Sadomasochism: Bondage tools, rubber costumes, anal plugs, whips, blindfolds/gags…

c. Sexual aid products: sex lozenges, time-extending spray/gel, aphrodisiacs, oral liquids to aid intercourse...

d. Products that describe or suggest sex with animals/children, rape, incest, graphic sexual violence or depravity: Games/videos/movies/pictures/photos with 18+ content (violence, suicide, sex, nudity...)

9. Intrusion Device

Devices used for illegal purposes, electronic surveillance devices and other electronic devices such as:

- Cable TV splitter.

- Wave blocking/jamming device.

- Lock cutting/breaking device.

- Power saving cheating device.

- Radar scanner.

- Traffic signal control equipment.

- Mini hidden, camouflaged, secret recording/video recording device...

10. Hazardous and flammable chemicals

a. Fireworks: Firecrackers, fireworks, bombs, pellet guns, smoke cannons, bombs made of gunpowder or other materials that can cause fire, burns, etc.

b. Chemicals related to the manufacture of explosives will be banned from sale: Sodium Chlorate, Potassium Chlorate, Potassium Perchlorate, NH4NO3, NaNO3, CH3NO2, KNO3, NaClO3, KClO3, KClO4, Hexogen, Trinitrotoluene, Octogen, Pentrit,..

c. Petrol, oil, gas

d. Lighter

e. Pesticides

11. Human body parts and remains

a. Human body parts: eyes, heart, kidneys,..

b. Human waste or body fluids: Sperm, oocytes, fertilized eggs, embryos, surrogacy or intermediary services (buying and selling of sperm, oocytes, fertilized eggs, embryos or surrogacy)

c. Remains

12. Products harmful to users' health

a. Toxic food: Food containing prohibited ingredients or exceeding the permitted ratio; food mixed without fully informing the buyer before the transaction;...

b. Used cosmetics, handmade cosmetics that do not have a declaration and documents about ingredients that ensure safety for users (eg: mixed cream, whitening cream, etc.)

c. Cosmetics/ dietary supplements that violate advertising regulations and cause misunderstanding about their uses are warned by competent authorities.

d. Cosmetics/functional foods containing toxic ingredients or content exceeding the prescribed level are warned or recalled by competent authorities.

e. Products that pose a risk to the health of users are warned by competent authorities or  102bid  regulations due to recorded cases of danger to consumers in Vietnam or in other countries.

f. Unpasteurized dairy products;

g. Wild mushrooms;

h. Any food item harmful to human health;

i. Medicinal foods: items that are introduced as having effects in diagnosing, curing, treating or preventing diseases in humans or animals; having contraceptive, anesthetic, or temporary or long-term physiological function inhibition/termination/enhancement effects (e.g., pharmaceuticals, weight loss drugs without origin label or mislabeled)

13. Medicines and vaccines of all kinds

a. Prescription drugs; non-prescription drugs but recommended by competent state agencies for limited use or use under medical supervision.

b. Medicines for animals.

c. Injections (botox, fillers and other injections)

d. Vaccines of all kinds.

14. Plants and animals

a. Animals and animal products (including wild animals) such as: dogs, cats, fish, snails, mice, porcupines, hermit crabs, hamsters, ivory, rhino horn, tiger balm, animal skin/fur,...)

b. Hunting equipment or tools that can harm animals or humans (fish shooting machines, electric fish stun guns, animal traps, etc.)

c. Physical products or media products that promote any form of animal cruelty.

d. Wood products are on the list of prohibited products according to the provisions of the Law.

19. Electronic surveillance equipment and other electronic equipment such as cable television splitters, radar scanners, traffic signal control equipment, eavesdropping equipment

20. Embargoed items

21. Food not included in the above prohibited categories must comply with the following minimum standards and principles:

- Use by date - all food items must be labeled with clear use by date information. Food items that are expired, within 30 days of their expiry date or less than 30% of their expiry date must not be sold.

- Perishable/Spoiling Food Items - It is the seller's responsibility to provide complete information in the product description and to ensure that the food is always properly packaged.

22. All products for sale must have their original labels/tags and packaging intact and must not be divided/extracted in any way, to ensure that buyers have proof to identify counterfeit or used goods.

23. Security and Privacy

Documents containing personal information. For example:

- Personal information such as mobile phone number, email address and other personally identifiable information.

- Software and products designed to extract personal information such as phishing websites.

- Identification cards, passports, social security cards and other documents can be used as proof of identity.

- Software, devices, instructions and services used to steal private, personal or organizational data are prohibited.

- Any other item that violates or is likely to violate an individual's privacy.

24. Prohibited by Law 

All items, or items containing ingredients:

(i) Illegal or restricted from sale under the Law of the Socialist Republic of Vietnam or encourages prohibited/illegal activities.

(ii) Assessed by any competent authority as posing a health risk or failing to meet safety standards.

25. Discount code:

- Discount codes provided by 102bid.com.

26. Products containing religious, spiritual, superstitious elements

- Items with keywords "mantra," "magic," amulets, charms, kumanthong, incense sticks for fortune telling, etc.
27. All alcoholic beverage products.

28. Equipment does not meet technical standards.

- 2G/3G phones do not support 4G/5G, radio equipment does not have a certificate of conformity.

29. Fresh food

- Fresh food is not traded.

30. Digital products: 

-  Game cards, Garena cards, online game payments, game items, movie packages, music packages, game/application accounts

 B. Prohibited acts in posting content, advertising, and introducing products/services

1. Prohibited content:

·       Information on products prohibited from sale is in section A. Prohibited products.

·       Reactionary, subversive, pornographic, violent, unethical, or infringing upon national sovereignty and security.

·       Spam information, damaging the reputation of 102bid.com service.

·       Insulting or provoking others.

·       Propagating information that violates the law (drug use, murder, robbery).

·       Encourage the use of harmful products (tobacco, alcohol, marijuana).

·       Obscene cultural products.

·       National secret documents, business secrets, personal secrets.

·       Human or human body part.

·       Animals and products from wild animals.

·       Products that are racist or insult ethnic/national groups.

·       Personal, family, and child images without consent.

·       Intellectual property infringement.

·       The product is on the 102bid.com prohibited/restricted list.

 

2. Prohibited acts:

·       Use of information, images, and sounds that violate the law or public morals.

·       Insulting the reputation, honor and dignity of organizations/individuals.

·       Use of personal images, words, or writings without consent.

·       Providing false or misleading information about products/services.

·       Directly compare price and quality with other products/services.

·       Unfair competition.

·       Advertising for other businesses/websites.

·       Posting duplicate products (spam).

·       Change the content of the post to cheat the rating.

·       Posting wrong product category, using incorrect images.

·       Unreasonable price increase before promotion.

·       Product pricing is too high/low compared to the market.


IV. TRANSACTION PROCESS

Procedure for Buyer:

       Register and log in to your account on  102bid .com. Verify your account information via email link or OTP via phone number.

       Search and refer to product/service information, prices, and support policies from the Seller.

       Contact the Seller directly (if needed) via “Message the seller” or place an order using the options: “Buy now,” “Select your own price,” or “Request a price.”

       Select payment and shipping methods, and provide a shipping address.

       The order is sent to the Seller for confirmation within the specified time; otherwise, the order is cancelled.

       Track order status on  102bid .com.

● Receive goods, pay (if choosing COD), check quality, and have the right to complain/return goods according to       102bid .com 's policy  .

 

Process for Sellers:

       Register an account, provide required information, and verify the account.

       Prepare news articles (text, images, videos) with clear product content, images in jpg/bmp/png format.

       Post products on the floor, comply with Seller Policy and be censored by  102bid .com management department.

       Confirm Buyer's order within the specified time.

       Prepare orders on time for delivery to the shipping unit.

       Receive inquiries, complaints and advise or handle complaints for customers about products or issues directly related to the seller.

1.      PAYMENT PROCESS

a. Cash on delivery (COD):

Select COD at checkout.

Pay cash to the delivery staff after checking the product.

 

b. Payment via VNPay gateway:

Select VNPay, enter card information (domestic, Visa, MasterCard, debit card).

Complete payment as instructed, receive confirmation notification from  102bid .com.

2.      DISPUTE/COMPLAINT RESOLUTION AND HANDLING PROCESS

When disputes or complaints arise,  102bid .com encourages negotiation and conciliation between the parties to reach a consensus on a resolution. If the Seller, Buyer and related parties cannot negotiate with each other,  102bid .com is responsible for resolving the case in accordance with current laws, regulations and policies on  102bid .com. 

The decision of  102bid .com is final except in cases where the case is handled by a competent state agency according to the provisions of law.

  1. Time limit for handling complaints:

-        Receiving and responding to complaints: Within 7 working days from receipt of complaint.

-        Complicated cases: Maximum 30 working days.

-        Remove violating information: Within 24 hours if requested by a state management agency.

 

  1. Complaint handling process:

       Step 1: Consumers submit complaints via website/application  102bid .com, email or directly at the headquarters, with information about the incident, seller, and evidence (if any).

       Step 2: The seller handles the complaint according to the buyer policy and seller policy; if it cannot be resolved,  102bid .com will accept and support mediation.

       Step 3: Negotiation/mediation between the parties to reach an agreement. The mediation result is as effective as mediation in court.

       Step 4: If no agreement is reached,  102bid .com will transfer the case to the competent authority and assist in providing information.

       Step 5: Publicly announce the violation (if any) on the website  102bid .com within 30 days as requested by the management agency.

 

  1. Note:

-        Prioritize negotiation and conciliation between sellers and buyers.

-        Prioritize complaint handling for vulnerable consumers (minors, disabled people, elderly people).

-        Secure complaint information and personal information of members (sellers and buyers).

 

V. RETURN/REFUND POLICY

A.    RETURN POLICY

1. General Return Policy

       Returns (exchanges or refunds) are subject to each seller's individual policy on  102bid .com. Buyers should check the seller's return policy in the product description before placing an order.

       Not all products are eligible for returns. Some products (such as digital, custom, or final sale items) may not be eligible for returns.

       Return Request Time: The buyer must submit a return request within 7 days of receipt of the goods, unless the law or seller's policy stipulates a longer period (e.g., 30 days for certain products).

2. Conditions for Returns

Buyers can request a return in the following cases, according to Article 8 of the Law on Consumer Protection 2023:

-        Defective, damaged or mis-described products: Products do not work as advertised, are damaged prior to delivery or do not match the description on the website.

-        Wrong product sent: The seller delivers a product that does not match the order (e.g. wrong model, size, color, quantity).

-        Right to refuse to receive goods (cancel order): The buyer has the right to refuse to receive the goods if the product is found to be incorrect in description or damaged at the time of receipt.

-        Wrong size/color: If the seller agrees, the buyer can request an exchange due to wrong size or color, depending on stock availability.

3. Conditions for Returned Products

-        Products must be returned in their original condition, including:

-        Unused, no damage by the buyer.

-        Full original packaging, labels, accessories and accompanying documents (if any).

-        Return requests must be submitted within 7 days of receipt of goods, unless a longer period is specified by the seller.

-        The product is not in the list of excluded returns (see section 5).

4. Return Process

Step 1: Submit a Return Request

       Buyers contact the seller directly through  102bid .com's messaging system or the "Return Request" section in their account.

       Requests must include:

       Order code.

       Reason for return (defective, wrong product, wrong size/color, etc.)

       Illustrative images or videos (if available) to demonstrate the product defect or problem.

       Customer contact information.

       Processing time: Buyer must submit request within 7 days from the date of receipt of goods.

Step 2: Seller Confirms Request

       Seller reviews return requests within 3 working days of receiving the request.

       The seller may request additional information, photos or evidence for verification.

       If the request is approved, the seller will provide return instructions (address, shipping method, etc.).

Step 3: Return the Product

       The buyer is responsible for packing the product according to the seller's instructions, ensuring the product is in its original condition.

●       102bid  's shipping unit will  pick up the goods at the buyer's address used to receive the previous order. The buyer will send the product to the address provided by the seller within 1-3 business days from receiving the approval confirmation.

       Shipping costs:

       Case 1: The fault lies with the seller (defective goods, wrong delivery, etc.), the seller bears the return shipping costs.

       Case 2: Not the seller's fault (due to the buyer abusing the policy), the shipping fee will be paid by the buyer. (When the buyer returns the item, the shipping unit will collect the one-way shipping fee in advance, the shipping fee will be refunded to the buyer at the Refund step if the fault is on the platform or the seller)

Case 3: Error from the shipping unit,  102bid  will work directly with the shipping partner responsible for the damaged order.

Processing Time: Seller confirms receipt of returned product within 3 working days of receipt.

Step 4: Processing Refunds When Returning Goods:

-        Refund confirmation time:  102bid .com will confirm the refund within 7 working days from the confirmation of valid returned product. The money will be refunded via the original payment method or as agreed with the buyer via bank transfer.

-        Refund processing time (from when the seller confirms receipt of the goods and the order is eligible for return): 24 working hours depending on the payment method. 

-        Refund Time: Depending on the payment method, the buyer receives the refund within 24 hours or 7-14 business days (depending on the payment method).

5. Limitations and Exclusions

       The return policy does not apply to the following cases:

       Digital products, services or non-physical goods.

       Custom, personalized or perishable goods (food, flowers, etc.).

       The product is in the Final Sale category, unless the product has a defect from the seller.

       The product has been used, damaged by the buyer or shows signs of illegal intervention.

       No refunds will be given if the product shows signs of misuse, tampering or damage after receipt.

       Accounts with a history of abusing the return/refund policy may be restricted or permanently terminated.

6. Responsibility of  102bid .com

●       102bid .com acts as an intermediary, assisting in dispute resolution if the buyer and seller cannot agree on the return request.

● If the seller does not respond within 3 business days of receiving the request, the buyer may contact       102bid .com customer support  for assistance.

       According to Article 35 of the Law on Consumer Protection 2023,  102bid .com is responsible for ensuring the rights of consumers when shopping on the platform, including monitoring and requiring sellers to comply with the return policy.

-        Support response time: Within 24-48 business hours.

8. Note

Buyers should keep the shipping receipt and related evidence when returning the product to ensure their rights.

This policy may be updated to comply with legal regulations and the operations of  102bid .com. Buyers should check the latest version on the website before making a return request.

 

 

B. REFUND POLICY

This process applies to transactions on  102bid .com and is carried out under the following specific conditions and times:

1. Refunds Due to Returns

Refund when the order meets the Refund conditions and is  confirmed by 102bid  for refund:

-        Step 1: After completing  the Return Process , the Seller confirms receipt of the goods within 7 working days from the confirmation of valid returned products and  102bid  approves the refund request within 24 working hours.

-        Step 2: Refund Processing: Refunds are made via the original payment method or as agreed with the buyer (bank transfer) within 24 working hours from when the seller confirms receipt of the goods and the order is eligible for return.

-        Time for buyer to receive refund: 24 working hours or 7-14 working days (depending on payment method)

2. Refunds Due to Order Cancellation (Prepayment)

Refund Conditions Due to Order Cancellation

       Orders using prepaid payment (via card, bank transfer, or e-wallet).

       The buyer cancels the order before the product is delivered or in the event that the seller is unable to fulfill the order.

The process includes:

-        Step 1: Complete  the order cancellation process , the seller has received the order back (in case of failed order delivery). The seller confirms and  102bid  approves the refund.

-        Step 2: Refund Processing: Refunds are processed via the original payment method within 24-48 business hours of cancellation confirmation.

-        Refund Time: Depending on the payment method, the buyer receives the refund within 24 hours or 7-14 business days (depending on the payment method).

3. Buyer Protection

● If the seller fails to respond or rejects a valid refund request, the buyer may file a complaint via       102bid .com 's Contact Us  .

       The platform will mediate and may refund the buyer directly if it determines the seller has violated the policy.

4. Buyer's Responsibilities

       Contact the seller via  102bid .com's messaging system to ensure proof of transaction is kept.

       Follow the return instructions to avoid delays or rejections of your refund.

       Check the seller's refund policy carefully before making a purchase.

5. Limitations and Exclusions

       No refunds will be given for products that show signs of misuse, tampering, or damage after receipt.

       Accounts with a history of abusing the refund policy may be restricted or permanently terminated.

       Sellers and buyers conduct transactions outside of  102bid .com 's processes and policies

VI. PROCEDURE FOR CONCLUSION OF ELECTRONIC CONTRACTS ON 102bid.COM

Legal basis:

       Law on Electronic Transactions 2023 – Articles 25 to 29.

       Law on E-commerce 2005 – Articles 36, 39.

       Decree 52/2013/ND-CP – Article 27.

 

Step 1: Buyer initiates transaction (Sends offer to enter into contract)

Buyers log in to the  102bid .com system, select products and click “Complete Order”.

The system records information: product, quantity, unit price, delivery address, payment method.

The act of clicking the "Complete Order" button is considered an act of sending an electronic contract proposal according to Article 25 of the Law on Electronic Transactions 2023.

 

Step 2: The system sends an order confirmation notification

After receiving the order,  102bid .com or the seller will send a confirmation notice via:

Email or account notification.

Specify: order code, confirmation status, expected delivery time.

According to Article 27, this is an act of accepting an offer to enter into an electronic contract if there is no other agreement.

 

Step 3: Contract payment

Buyers make payment through one of the following methods:

Electronic payment: bank transfer, e-wallet, linked payment gateway.

COD payment: pay upon receipt of goods (identified as late contract performance).

Transaction data is stored and encrypted as prescribed in Article 16 – Ensuring integrity and confidentiality of data messages.

 

Step 4: Delivery and contract completion

The seller/stall makes delivery as agreed.

Once the buyer receives the goods in full and has no complaints, the electronic contract is considered complete.

 

Step 5: Cancel order / Withdraw request

According to Article 26 of the Law on Electronic Transactions 2023

The Buyer has the right to withdraw or cancel the offer to enter into a contract (order) if:

       Done before the seller confirms the order;

● Or according to       102bid .com regulations  (if cancellation is allowed after confirmation).

       If the seller has not accepted the contract (has not confirmed the order), the offer is not valid.

       Once confirmed, cancellation is only possible if both parties agree, or if there are regulations allowing cancellation under specific conditions.

 

VII. TRANSACTION SECURITY GUARANTEE

102bid .com uses measures to protect Seller's product/service information.
